My understanding has always been that it's not the caliber but the fact that it's a replica.
If it looked like a toy and shot the same caliber paint as the 3357 it would be legal but because it looks like a real gun...

There are also restrictions on pellet guns that can shoot over a certain velocity - you need a firearms permit to own one.
