You have to report it to ebay. Would he have given you a refund if it went higher than he expeced? No. If you arn't willing to accept the results of an auction then don't use E-Bay or only put up BINs.

I did send extra money once on a ebay auction (I wasn't asked for more, I just sent it along). HaveBlue was auctioning off a bunch of stuff. one of his listings was a bunch of crap, I ended up winning it for 1+5(shipping). When the box arrived it was marked with about $8 shipping from USPS. I felt bad and sent him an extra 5 bucks to at least cover the shipping.

Agreed, report it to eBay and let them deal with the seller and also wait until the neigh-last moment to leave horrible feedback to warn others of how they backed out on the completed auction.

Was this a Mag that sold a couple of weeks ago? Kid didn't put a reserve on it but in the description mentioned something about a reserve. When I asked about shipping if the item went for less than his free shipping price he informed me that it wouldn't because that was his reserve level. The Mag went for less but not to me.

If the reserve option isn't used, then text in the auction stating a 'reserve' price means nothing. He should've ended the auction to correct it and add the reserve.

Report it to ebay and to the internet fraud center http://www.ic3.gov/ if you mailed the payment it also constitutes mail fraud.

Just like buyers have to lived up to paying for items, seller has sign a legal and binding agreement to deliever the item. Period. Ebay has gotten into the habit of favoring power sellers and very active sellers, but you do still have the legal right to claim the item.

Report him/her to eBay. (There is a complaint form). Let the complaint run it's course. Leave negetive feedback as described earlier, at the end of the 90 days, and if he/she leaves negetive feednback BE SURE YOU RESPOND TO IT.

Many times I sold items on eBay that went for less then I had hoped for, but I still was required to stick to the sale.

Report it, or the next guy will get screwed too.

How many times has he gotten away with doing the same thing if something hasn't sold for what he wanted?.

I don't ever use a reserve anymore, I just start the auction at the lowest I will take for the item and let it go from there. I think it is a load of crap when someone starts a auction at $.99 then sets a reserve of $300.00 for an item. Just my 2 cents. report Him and let ebay sort it out.

Agreed with all who say to report him.. I do a lot of dealings on ebay; had one issue that I had to escalate and it got resolved. Certainly...certainly...report him.
