I wouldn't worry about a used dive tank. Your legal defense there is DOT/PADI & NAUI say its safe enough to strap to your back and go 1/2 a football field deep underwater. I'd be more concerned about limiting the muzzle travel of the markers so the paintballs/reballs don't exit your Playing area. Might even try to work out a deal for renting tanks from the same place you were planning to get them filled.

You can find used tanks at Scuba shops that have already been hydro and checked out. There is a scuba shop in a town near me that checks and puts the used tanks aside for paintballers.
