maybe the restriction doesn't have to be done through the social workers. for example: i wonder why, if he was already a suspect (ahem "person of interest"), that potential witnesses were still sent to meet him just based on custody.

Bad idea. First of all, "person of interest" is a BS term with no legal meaning. Second, allowing state or federal prosecutors or law enforcement to take away fundamental rights outside the existing criminal justice system is the very definition of denial of due process.

Looking at this case I can't help but think of the recent local case of Gail Palmgren. Very similar situation: wife disappears and leaves behind two young kids and a husband who as a "person of interest" is all but tarred and feathered by the media and the community. The wife's family tried their damnedest to take the kids away from him too- I was working for the judge hearing their petitions and sat in on the hearings.

In the end, after all the damage was done, it turned out she had just flipped out one day and drove her jeep off the mountain.

the difference is powell's kids voiced out on their own that their mom was in the trunk.

Perhaps, a supervised visit should have been at a neutral location, not at his home. But, then again, it takes time for things to change, because no matter what, it's all a bureaucracy that actually runs things.

If the commentary of the children had bearing on the case, then he would be in jail.

Imma gonna side with the Inflicted on this one... He's a legal professional, and he makes a stronger case than "more government restrictions."

Since we're playing what-ifs... What if the government hadn't interfered with his parental rights? Would the kids still be dead?
