Dealing with financing companies? (repo/theft)

I haven't been around much lately. A few of you know how hard life's been sucking lately. This is just the newest FML.

So, I come home on my bike and my car is missing.
Call the police, they say that 1) it's registered to a different tag number than I gave them and 2) it's marked as repossessed.

Now, I make payments every two weeks, and have record of this. Drop it in the night box and go. The worst that happens is I get off work after they close and it's waiting in the box in the morning. I do have scans of every check printed out, and the bank shows deposit dates between 2 and 9 days after they receive them, even on the Thursday-morning stuff.

I can see a complaint for a 'late payment' on the Friday night stuff, but it's waiting in the morning for them, and they haven't offered any complaints yet, unless they failed to update my phone number.

So... What are my options for recourse here?

Contact the loan institution you went through and get all of your documents gathered up so you can talk with them. More than likely you will need to talk to someone face to face. Good luck.

no offense, but this suggests your credit may not be stellar; depending on the terms of your loan, there may be late fees, etc. that are accruing if the payments aren't posting to the account on the specified due date - interest never sleeps...

contact your lien holder - ask for a copy of your complete payment history, and if need be, ask them to walk you through any missed/late payments that had an adverse effect on the outstanding balance.

it's possible that, as you suggested, they may not have an updated number (or address for that matter).

if possible, it's always a good idea to bank with the financial institution that funded the loan - makes payment transactions quicker and easier.

edit - just curious, who's the lender?

Well, the terms were $50 a week. I asked, and was assured, that paying every two weeks (payday) for $100 was just fine.

I'll get in contact and ask for documents, because my bank has scans of every check dated Thursdays and Fridays, and deposit dates.

I should have been going in and getting receipts.

If you are correct then it was a mistake and they will return the vehicle.

If you are incorrect you are missing information.

Have you moved? Changed your phone number? Do you open your mail, or does someone else?

I have been in the same apartment for years now. I have changed my phone number, but told them when I did so six months or so ago.

I at least see all the mail, and received nothing from them.

So unless they hadn't updated my number, there's nothing for it.

Alright, called them up, proved my bank records. The check for 2/22 didn't get deposited until 3/1, and wasn't in the computer. Still irritates me that my car's gone on 3/3...

Anyway, they're having it towed back to their office. I'm going to go while they're open to inspect it and figure out if I need to berate them a bit.

That's their fault.

If I was you, I would tell them they have to pay to have it inspected at a DEALER to check it for damages, etc.

It's obviously a "buy here pay here" lot and they are the dealer and actually own the car until it is paid in full. They are notorious for this kind of crap just be glad they are willing to give the car back without any hassle and look forward to better days when you don't have to deal with them anymore.

The lot was a "buy here, pay here," and once the car is off and titled they send it off to a financial agency.

Not sure if the agency is just collects, or if the lot gets their money from them and I pay off their loan.

I'm going to go there during business hours to make sure everything I left in the car is still there and check for noises and such. They will immediately hear about any problems.

I almost feel sorry for the guy I talked to about this, because he only works the counter and computer, and has actually been great at his job. He put me on hold to check on the paperwork, and the first thing he said when he got back was "I'm getting it brought back here as soon as the driver can get it." The screw-ups have desks where they don't have to deal with the people directly.
