Given he committed an illegal act and ignored warning shots I fail to see how a suit would even make it to court. If the police are saying that the penas were within their rights to shoot and kill the intruder and the DA refuses to press charges I can't see how a civil suit would get far. What exactly would they sue for anyways?

You have too much faith in the legal system.
They could easily sue them for killing him resulting in emotional or financial distress saying that they could've "just wounded" him instead killing him....stupid yes i know, but depending on where you live, something like that is entirely possible.
There are many cases in which burglars have broken into homes, injured themselves, sued, and won. If this is possible, i dont see why the relatives of a killed burglar wouldnt be able to do something similar.

Not that familiar with the law, but doesn't "stand your ground" give you immunity against civil lawsuits?


Edit: Maybe I'm thinking of the castle doctrine.

^ yea the castle doctrine protects you, but every state is different on those type of laws and some don't have them.

Some CCW instructors around here say make sure to do the job. They can't sue if they are dead. If they are alive they can tell their "story." In Kansas however I think it is fairly straightforward. Just don't use reloads, even jacketed, no HP.
