I think Carter has hit the nail on the head, and this will probably stay where it is. When you take it before the 9 Justices, it's for all the marbles. If the judges decided and interpreted the laws to say that the 2nd amendment allows all weapons, then we're talking the collapse of all major gun laws in the country. That's HUGE! That's a lot to wager for just a few handguns in Washington DC.
The inverse is that if the Supreme Court says that the government can infringe upon the rights of the citizens, then there are states that, though they now have to technically allows gun ownership somehow, will then completely ban any form of gun ownership except for their own police units.

Either way, it's HUGE. And you can't appeal it, change it, alter it, etc. You're talking the final say!

This should be interesting to watch.

You'll likely never see the Justices try a direct case that hinges on the interpretation of the Second ammendment.

They've been scrupiously avoiding it since US vs. Miller.

Why?

Think about it - either they aggree with what is called the common interpertation, and instantly repeal every gun law in this country, or rule it a collective right, and have 80 million gun owners severely pissed off.

They don't want to upset the applecart. They may nibble around the 2nd, but they'll never, ever rule on it's actual interpretation.

Best aregument I have seen on this lifting onthe band in DC is that there is no way to legally purchase a handgun in DC because of the lack of places to buy and places to legally transfer.

It was hinted at this is a way to sniff out the people that followed by their constutional right, and worked ways around the DC law.

Interesting how the same people who yelled about taking them off the streets to make it safer all the sudden woke up and said having them would make it safer.

Oh yeah, Carter.. that law about the state police here not keeping arecord of serial numbers was found out a couple of years ago to be null, since the police here have been breaking that law for years.

So, being a DC resident, do I have to wait for this to go through the whole system, or can I go back to my parent's house in WV and pick up my .45ACP and my Luger P-08 and bring them back to my place? I know you are required to have a DC driver's license AND register the arms with the DC Metro police Dept for Rifles and Shotguns, but I think it SPECIFICALLY spells out rifles and shotguns, does this mean I get a loophole here?

Could you imagne what would happen if there was a sudden ruling that would say the 2A was a right of the government and not of the peope.. and outlaw private ownership?

We would have the uprising that Thomas Jefferson spoke about in his writings.

Dont know if I would liek to see that day, ut I do think it would bolster our country and ultimately either bring it to an end or make it much, much stronger.

I think you'd see a split much like the civil war. The government would be intruding on the personal rights of it's citizens to a degree which the founding fathers tried to keep from happening when writing the constitution and the bill of rights.

I'd just like to say that since moving to DC a few years ago, I have seen more handgun related crime than I ever saw anywhere else. I see more shooting every day here than I did in Baltimore, and that's saying something! I rank DC's gun ban right up there with Prohibition as a noble experiment which ultimately backfired. The saying, "If you outlaw guns, then only outlaws will have guns" has been proven all too true over the past 30 years. My room-mate is a huge advocate of gun-control, but not even he can come up with a solution to the crisis that affects the DC public with gun-crime. Two people were shot in my neighborhood just 3 blocks off of 18th and Columbia (Adams Morgan) in a drive by two weeks ago. This is a street-corner that is heavily patrolled and has a police camera on it at all times. The fearlessness with which the criminal element of this city commits their murders and attempted murders with illegal hand-guns is simply amazing. And while allowing the law-abiding citizenship of the district to own handguns won't do anything to keep illegal fire-arms out of the hands of the criminal masses, it WILL possibly give them pause to think before attempting to commit a crime against a law-abiding citizen in the future. If the law is indeed repealed, I WILL get a CCW permit so that I have the option to protect myself even though I will most likely not carry my weapon with me on a regular basis.

I also wonder, if the act is repealed for being unconstitutional, isn't it also unconstitutional to keep it on the records of those convicted of carrying a fire-arm in the district? makes you wonder.
