I wasn't suggesting he charge royalties, I was suggesting he assign the rights to someone who could afford the high costs associated with litigating an intellectual property matter, maybe do it at no cost with the caveat that if they won there would be no enforcement of the rights afterward... at least the company he would partner up with could avoid paying more licensing fees...

I'm glad to hear everything is coming together...but I belong and sit on to several 501c's ...and others including political pacs...I'm in the building trades(board director for local Building Association and Board member on the Governmental Affairs Committee) and Realtor/small developer.( member of the tech board for the Realtors Association)...please don't except money now until you set it up...it must be traceable and within a certain time period....at least here in Florida...so I sugguest wait until it's set up to except monies...

When it is set up...let me know..I'll sell a marker set-up and pitch in some of the profit...

I don't know of your personal dealings with Dave, but in my several, he has always been a man of his word, and of high morals. If you have a personal experience (ie, other than third party hearsay), than I can understand your viewpoint, but I'd hate to brand someone based on anything other than firsthand knowledge, or at least full knowledge of both sides of any issue.

As far as forcing SP to back off.. I'm 99% for it. I will look at the finances to see if I can be 100% for it

we are raising a small amount of funds to cover the costs of doing the above. It is clearly stated that there is no existing tax exempt status at the current time.

any remaining monies will either be returned to their respective donaters or, upon their direction, donated to the organization when it is founded.

Does video shot by a teammate showing him wiping more than once, not current but 12-15 years ago when it held more stigma, count? How about another teammate who also played on a JT sponsored team (pro level) where Dave personally assisted with providing clean goggles for every game, he was on the sidelines handing them the goggles. Davy would rant and carry on in a very immature manner when things didn't go his way. Of course both situations happened over 10 years ago when he was very young and immature

If I'm not mistaken, AKA already signed agreements with SP that limits their ability to produce any electronic markers. So, even if any lawsuit against SP went south (oh wait: that already happened with SP vs. WDP), I don't think AKA would have any legal right to reverse its agreement. I don't think "fruit of the poisonous tree" works in the opposite direction... then again I didn't get an A in Law Class, so maybe I'm wrong...

Well it should, since AKA signed the agreement assuming SP was not full of crap. With the dumpy system in place though, AKALMP would probably have to go back to court and blow a ton of money to fix the problem. They are better off focusing themselves in a different direction.
