if the question is decided that the appointment of those judges was unconstitutional, then, any decision that was made by even one of those judges (they're on a panel), can be contested.

The appeals board handles interference issues: you're patent infringes on my patent (how'd we both get one?). I also believe it decides issues on the scope of claims (my claim covers every single type of method used to hold two or more sheets of paper together. no, your patent only covers such methods that employ a semi-permanent method of attachement)

when you do an interference issue - BOTH patents in question come up for review and either of them could be found to take precedent over the other, not just the appealer's.

The only people who can bring such an action are those who own or have been assigned the patent.
