Have you thought about giving him another chance. Maybe you just have to give him another rusty trombone before he will pay up on what he owes you.

No. Not at all. That's not how business works.

I pay you for something that you offer to sell to me, then you ship it to me.

Not "I pay for something that you offer to sell me, then I wait until someone else pays me for something and THEN I send you something."

It does though. People screw up, that's fine, I get it. The issue here is that he has been a repeat offender and is basically a thief.

There is really no way at all that this could be spun in any way other than him stealing money. If you want to defend him, that’s on you guys. If he “wants to make good” then why does he only come back for a brief stint, only offer to SELL MORE to the people that have both already paid and those that want to jump in line who are clueless to all of this, and then disappear for another year with ZERO RESOLUTIONS?

That’s an honest question, too. Why would he do that to his customers?

Because they aren't customers they are potential and current victims.

Why doesn't anyone either take him to small claims court or have him charged with fraud?
If someone runs with this, get a list of the victims (names, addresses and amounts) who lost money and someone goes to his local agency, have a police report taken. Once the report is written it will go to the correct detective who will investigate and hopefully contact him. Now, this will either scare him enough to get your items or at least a refund and possibly charged criminally if there is enough evidence.

Just my two cents.

Because small claims court is voluntary appearance, you would have to have somebody in his same state with a claim to file, and the only thing you could get is a recommendation to take it to real court under a civil suit. And then even if you got a civil suit filed maybe even a class action with all the people that have been ripped off you would need to have $100k+ in judgement to make it worthwhile after paying attorneys and court fees.

This genuinely does not make any sense...

It’s been a long time, but I did take a business 101 class in 93. It was an 8am class and I think I got a c minus. But I seem to remember that business actually works the opposite of this. When you manufacture something, sell it and charge for shipping, the amount you receive should cover those cost plus something left over. That’s called “profit”. When you have to sell something else to cover cost to get it out the door after you’ve received payment, that’s a sure sign that, in actuality, your business didn’t work.

Right!

But the trick is: he’s lying
