Appeals Court Overturns D.C. Gun Ban

WASHINGTON (AP) -- A federal appeals court overturned the District of Columbia's long- standing handgun ban Friday, rejecting the city's argument that the Second Amendment right to bear arms applied only to militias.

In a 2-1 decision, the judges held that the activities protected by the Second Amendment "are not limited to militia service, nor is an individual's enjoyment of the right contingent upon his or her continued intermittent enrollment in the militia."


A lower-court judge in 2004 had told six residents they did not have a constitutional right to own handguns. The plaintiffs include residents of high-crime neighborhoods who wanted the guns for protection.
The Bush administration has endorsed individual gun-ownership rights, but the Supreme Court has never settled the issue.


If the dispute makes it to the high court, it would be the first case in nearly 70 years to address the Second Amendment's scope.

The only problem that I see springing from this ruling is this; How are the neo-conservatives going to turn this into an outrage perpetrated by liberal activist judges?

Don't think you can.. lol... This (to me) was a good call. I always wondered how they "got away" with having a ban... Now I see they can't.

This will definitely move up the ladder to the high court, but I don't see how it can be argued to be overruled.

Now if they would just let me have the right to bear hand grenades... well... I'd be a happy man.


I mean, come on!!! Who wouldn't want a hand grenade just to try once!! Ah.. what I wouldn't give.

Now if only they can change the way you get handguns legally in NY...

In PA... you turn 21, you walk into a gun store, pic out your gun, fill out paperwork for the backgroung check.. they make a phone call.. if you have been good you hand them money and walk out with your gun. If you want to carry it for protection you go through a process that takes about a month, and get a permit.

In NY... you get the permit first..which takes about a year.. and then you can get a gun...and everytime you want a new handgun, you can buy it..but then you have to go back and have them revise the permit to show the serial number of EACH gun you own!!!!

Really? No kidding. Yeah.. NH is the same way as PA I suppose. Walk in... Buy the gun. They make the call... And off you go.

And they are actually NOT allowed to keep the serial number of the gun. I think by law they can't keep it for more the 24 hours or something like that.

That's why I never understood those CSI shows tracking down the guns for the longest time. It would be impossible to have that show in NH. You just can't do it.

They only keep track of Class III weapons here... Full autos, silencers, etc. I've yet to buy one, but I think I'm going to pick up a silencer, pay my $200.00 tax stamp, and wait a few months. Just to check out the process. And have something fun to use out my back porch so I don't bother the neighbors as I do now!

In IA its:
call local sheriff's office, let them know you want a handgun, they send you some paperwork, you send it back, they do some checking etc.. they send you a permit, and you can go show the permit in a shop and buy your handgun.

Or

You go meet Billy in his van in the parking lot across from Ye Olde Gun Shoppe and he sells you a handgun.
Went with my brother once when he got an M1 Garand with this way, and although that wasn't illegal, I'm fairly sure he would have sold me a colt 1911 if I had asked nicely.

yea we do have some strict handgun laws - but rifles, shotguns - those are easy to get.

getting a carry permit in New York is almost next to impossible.
